Terms of delivery:

Under the Distance Selling Act you are entitled to return the ordered article within a two week period after receiving the goods. Excluded from this right are software products and CDs, DVDs, CR-ROMs and videos which have been unsealed by you as well as personalised fan articles of all kinds and flocked or printed products unless the item is faulty. In this case only a replacement by exactly the same item is possible. We only accept returned items that have been sufficiently stamped by the customer. For items that are faulty or have been delivered in error we will refund the customers actual expenses incurred by returning the items. The right of return is exercised by dispatching the received items in due time. The purchase contract is hereby cancelled. A refund will be issued within a reasonable period of time (on the 1st and 15th of every month). Shipping costs incurred by us are not refundable as we have provided a service for the customer. To meet the deadline for the returning of goods, timely mailing shall suffice as long as it is sufficiently stamped.
General terms and conditions:

1. Preface
The following terms and conditions apply to all contracts, deliveries and other services. We herewith contradict any regulations of the contracting party to the contrary. Any collateral agreements, amendments to or supplements of this agreement must be in writing in order to be valid.
“Jamaica-Shop.com” is entitled to change or amend these terms and conditions including all potential enclosures at all times if an appropriate notice period is observed. Previously received orders will be dealt with according to the old terms and conditions still in force at that time.

2. Offer
Our offers are non-binding. Slight variations and technical supplements of our illustrations or descriptions are possible. A new catalogue supersedes all previous catalogues.

3. Delivery and Payment
The terms and conditions of delivery and payment for "Jamaica-Shop.com" are stated in detail on the order form.
For personalised items we ask for prepayment of at least 50 % when placing the order.
There is no minimum order quantity. All our prices include the statutory value added tax of now 19 %. The right to partial delivery is reserved, if this is considered to be advantageous for the transaction. If the customer wishes for special forms of delivery, the exceeding costs will be charged.

4. Delivery times
Goods in stock (we are not liable for problems during transportation) will be dispatched within an average of 2-5 days. Delivery times will not exceed 14 days. If the goods are not in stock upon ordering, we will make an effort to deliver as fast as possible. If failure to comply with a delivery deadline or service deadline is due to an act of god, industrial conflict, unforeseeable obstacles or other circumstances for which we are not responsible, the deadline will be adequately postponed. Upon non-compliance with the deliver deadline for other reasons the buyer is entitled to fix a reasonable period for performing the delivery with a declaration that he will decline the sales contract after the expiration. In case the disability of delivery depends on the manufacturer or a sub-supplier, either the deliverer or the customer can cancel the sales contract if the delivery time exceeds 2 months. Damages for non-performance resulting from delay, impossibility or non-fulfilment are barred, included those generated until rescission of the contract, unless a legal representative of "Jamaica-Shop.com" acted demonstrably false or wantonly negligent.

5. Sale or return
We guarantee sale or return within 14 days for all unused products returned to us in a resalable condition including original label and package. The deadline for returning goods is preserved by sending back the commodity within the prescribed period. Excluded from this right are price-reduced products (special offers), products on special sale, software products and CD´s, DVD´s, CD-ROM´s and videos, which were unsealed by you, the special productions of merchandise products of all kinds as well as flocked or printed on products, unless you detect a fault. In this case an exchange takes place, but only against exactly the same product. We only accept returned parcels when they are sufficiently stamped by the customer. For incorrect or wrongly delivered commodity, we naturally take over the actual customer return transmission costs. To keep the term of the return right the sending date of the received goods is valid. Thereby the sales contract is dissolved. A reimbursement will be done in the appropriate timeframe (1st  and 15th of each month). The reimbursement of forwarding expenses is completely impossible.

6. Passing of the risk
At the time of sending off the commodity by "Jamaica Shop.com" the risk is transferred from seller to the buyer.

7. Guarantee
"Jamaica Shop.com" ensures that at the time of the shipment the sold commodity is free of the risk of material and factory defects and that the contractually assured characteristics exist. Upon delivery, the customer must immediately examine the commodity and report any faults. We must be notified in writing of any fault within 10 days after discovery. Otherwise the guarantee for the fault is void. The guarantee is valid for 6 months. To exhibit complaints the purchase date must be proven by the customer with the invoice. The faulty article must be sufficiently stamped and returned together with a copy of the invoice. The guarantee expires, if the customer changes the supplied items. During the warranty "Jamaica Shop.com" has the right of free rework. A partial or complete exchange of the article is permissible.

8. Patent rights brands and patent laws
We point out expressly that we protect the patent rights of the trademark owners when we do production or fabricate custom-made products. With the placing of an order the customer/client confirms in the possession of all rights to be, which are necessary for the production. This applies in particular for the author, brand, patent and license right. The client is responsible for violation of legal provisions of a contract. This is valid also for the reproduction for registered trade marks etc. registered logos, which are provided as custom-made product on customer's request by us. Orders, which intervene in third party’s privacy, have to do with pornographic contents, or any kind of criminal offences will not be executed by “Jamaica-Shop.com”. The customer’s relevant data for the job execution are stored by us and treated confidentially. For both contracting parties place of delivery is Cologne / Germany.

9. Reservation of proprietary rights
Up to the complete payment the property of the commodity remains to “Jamaica Shop.com".

10. Data storage
In accordance to § 28 of the Federal Law for Data Protection (BDSG) we advise that in the context of the processed transactions the necessary data are  stored by the computer system in accordance to § 33 (BDSG). Personal data are treated confidentially.

11. Place of jurisdiction
Place of delivery and area of jurisdiction for both parts is the registered business address of "Jamaica Shop.com" (Cologne, Germany). It is valid excluding the Court of jurisdiction is the Federal Republic of Germany.

12. Security
We give you the possibility to transfer your payment by “Pay Pal” or by cash on delivery (within Germany).
